How to File an ADA Complaint

Under Title II of the Americans with Disabilities Act of 1990 (ADA), the Department of Public Safety and Correctional Services (DPSCS) cannot discriminate against people with disabilities who are incarcerated, detained, or under supervision. This means we must provide equal services, programs, and activities to everyone, regardless of their disability.

1. How do I file a disability discrimination complaint with the DPSCS?

If you think an incarcerated individual or detainee with a disability faced unfair treatment in a DPSCS facility, you can submit a complaint to the DPSCS Director of ADA Services. You can send your complaint by mail, online, or by calling the hotline. All new complaints will be looked at and reviewed.

2. What to Include in Your ADA Complaint?

Provide the following details:
Your Information
  • Full name
  • Address
  • Daytime phone number
Incarcerated Individual’s Information
  • Name
  • SID (State Identification) number
  • Current location in the facility
Institution or Person Involved
  • Name of the institution or individual you believe discriminated against the incarcerated person
  • Address of the institution or person
Description of Discrimination
  • A short explanation of what happened
  • Dates of the discrimination
  • Names of people involved
Additional Information
  • Any other details you think are important to support your complaint
  • Copies of relevant documents (not originals)

3. What happens after you send in your complaint?

When we get and look at your complaint, we will tell you what steps we plan to take. These steps could be:

  • Asking you for more details or copies of important documents;
  • Sending your complaint to the right facility ADA coordinator for their review;
  • Looking into your complaint. If we can't act on your complaint, we will send you a letter explaining why.

4. How to Check the Status of Your Complaint?

To check the status of your complaint, follow these steps:

  1. Wait for Our Response: We carefully review each complaint. This can take up to 30 days.
  2. Follow Up: If you don't hear from us within 30 days, you can find out the status by emailing [email protected].
  3. Get a Response: A staff member will contact you to tell you if your complaint has been received and if it is still being considered for action.
Keep Records: Please keep a copy of your complaint and the original documents for your own records.
